Ørsted has announced plans to seek a preliminary injunction against the recent construction halt of its Sunrise Wind project in the United States. This follows a similar legal move regarding the Revolution Wind project, developed in partnership with Skyborn Renewables.

Ørsted intends to file a complaint in the US District Court for the District of Columbia, challenging the lease suspension order issued by the US Bureau of Ocean Energy Management (BOEM) on December 22, 2025. A motion for a preliminary injunction will follow.

The Sunrise Wind project, located off New York, is nearly 45% complete. Ørsted has installed 44 of 84 monopile foundations, the offshore converter station, and nearshore export cables. The onshore electric infrastructure construction is also largely finished.

At the time of the lease suspension, the 924 MW project was projected to begin power generation in October 2026.

Ørsted expressed that Sunrise Wind is facing significant harm from the continued lease suspension and emphasized that litigation is necessary to protect the project’s interests.

The company stated, “Sunrise Wind secured all required local, state, and federal permits, following extensive multi-year reviews. As part of the permitting process, the project engaged in lengthy consultations with the U.S. Department of Defense Military Aviation and Installation Assurance Siting Clearinghouse to address potential impacts on national security. These consultations resulted in a formal agreement with the Department of War, the Department of the Air Force, and Sunrise Wind outlining mitigation measures.”

Located approximately 30 miles (48 kilometers) east of Montauk, New York, the offshore wind farm will feature 84 Siemens Gamesa 11 MW wind turbines and connect to New York’s electricity grid at the Holbrook substation in Brookhaven, Suffolk County. It is the first US offshore wind project to utilize high-voltage direct current (HVDC) system.

When Ørsted announced it would seek a preliminary injunction for Revolution Wind with Skyborn, the project was about 87% complete and anticipated to start power generation this month.
